1. Introduction and Scope

St John’s Recovery Place, LLC, also known as SJRP (“SJRP,” “we,” “us,” or “our”), respects your privacy. This Online Privacy Policy and Cookie Policy explains how SJRP collects, uses, maintains, protects, and discloses information obtained through SJRP.com and other websites, online forms, and digital services that link to this Policy, collectively referred to as the “Site.” This Policy also describes certain practices relating to email, SMS, MMS, and other electronic communications you have with SJRP in connection with the Site or an inquiry regarding SJRP’s services. For purposes of this Policy, “Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to an individual or household. Personal Information does not include information that has been lawfully de-identified or aggregated so that it cannot reasonably identify an individual. This Policy applies to information collected:

  • When you visit or interact with the Site.
  • When you complete a contact, admissions, insurance-verification, payment, employment, or other online form.
  • When you communicate with SJRP by email, text message, telephone, chat, or another electronic method.
  • When you interact with an advertisement or online service that links to this Policy.
  • When an authorized representative or family member contacts us on your behalf.

This Policy does not replace SJRP’s Notice of Privacy Practices. Information that constitutes protected health information under the Health Insurance Portability and Accountability Act of 1996, commonly known as HIPAA, or a substance use disorder patient record protected by 42 C.F.R. Part 2, is also subject to SJRP’s Notice of Privacy Practices and applicable law. To the extent this Online Privacy Policy conflicts with the Notice of Privacy Practices or applicable healthcare privacy law, the Notice of Privacy Practices and applicable law will control. Website use is not SMS consent. Merely visiting the Site, accepting this Policy, or providing a telephone number without separately requesting or agreeing to text messaging does not enroll you in an SMS or MMS messaging program. The Site and its forms are not intended for medical emergencies. If you are experiencing a medical emergency, call 911 or seek immediate medical assistance.

2. Information We Collect

The information SJRP collects depends on how you interact with us and the services or information you request.

Information You Provide Directly

You may provide Personal Information when you contact SJRP, request information, submit a form, verify insurance, apply for employment, make a payment, communicate with our admissions personnel, or otherwise interact with us. This information may include:

  • Your name.
  • Telephone number.
  • Mobile telephone number.
  • Email address.
  • Mailing address.
  • Date of birth or age information, when relevant.
  • Preferred method of communication.
  • Information about whether you are seeking assistance for yourself or someone else.
  • General information about treatment needs, services of interest, or the reason for your inquiry.
  • Scheduling and availability information.
  • Insurance carrier or insurance-verification information.
  • Information submitted in a message, contact form, email, or text conversation.
  • Records of SMS consent, communication preferences, HELP requests, and opt-out requests.
  • Employment, résumé, or job-application information.
  • Payment or transaction information submitted through SJRP or a payment-processing provider.
  • Any other information you choose to provide.

Please limit the sensitive information you submit through general website forms, email, or ordinary text messaging. Do not send Social Security numbers, financial account credentials, complete medical records, detailed diagnoses, insurance member identification numbers, or similarly sensitive information unless SJRP has directed you to an approved secure method.

Information Collected Automatically

When you visit the Site, SJRP and its service providers may automatically collect information about your browser, device, and interaction with the Site. This may include:

  • Internet Protocol address.
  • Browser type and version.
  • Device type.
  • Operating system.
  • Device or online identifiers.
  • Approximate geographic area derived from an Internet Protocol address.

Information Received From Other People or Organizations

SJRP may receive information about you from:

  • Publicly available sources.
  • Other parties involved in a transaction or requested service.

The fact that another person or organization gives SJRP your telephone number does not, by itself, authorize SJRP to send you text messages. SJRP obtains text-message consent directly from the intended recipient when consent is required.

3. How We Use Personal Information

SJRP may use Personal Information for the following purposes:

  • To provide general information about treatment, admissions, scheduling, availability, and next steps.
  • To communicate with prospective clients, clients, patients, family members, authorized representatives, and other people who contact SJRP.

  • To provide services and administer the relationship between you and SJRP.

  • To evaluate the performance of pages, advertisements, forms, and communications.

  • To comply with legal, regulatory, licensing, accreditation, insurance, audit, and recordkeeping obligations.
  • To protect the health, safety, rights, property, or security of SJRP, its personnel, its clients, its patients, Site users, or others.
  • To evaluate employment applications and administer recruiting activities.
  • To send advertising or marketing communications when permitted by law and consistent with the recipient’s communication choices.
  • To create aggregated or de-identified information for lawful business, research, analytics, quality-improvement, and operational purposes.
  • For another purpose disclosed when information is collected or with your direction or consent.

SJRP will not treat general acceptance of this Online Privacy Policy as consent to receive promotional text messages.

4. Cookies and Similar Technologies

The Site may use cookies, pixels, web beacons, tags, local storage, analytics tools, and similar technologies. A cookie is a small file that a website stores on a browser or device. Cookies and related technologies may help websites remember preferences, maintain security, understand website usage, measure performance, and deliver or evaluate advertising. The Site may use the following types of technologies:

Essential and Functional Technologies

These technologies support basic Site operations, security, accessibility, navigation, form functionality, traffic management, and user preferences.

Analytics Technologies

SJRP may use analytics providers, such as Google Analytics or similar services, to understand how visitors reach and use the Site. Analytics information may include Internet Protocol addresses, device information, pages viewed, referring sources, interactions, and approximate location information.

Advertising Technologies

SJRP and advertising providers may use cookies, pixels, or similar technologies to measure advertising performance, understand whether a visitor arrived through an advertisement, limit repeated advertisements, or deliver advertising believed to be relevant. Advertising providers may collect information about activity over time and across websites or online services. Depending on applicable state law, certain disclosures of online identifiers to advertising providers may be considered a “sale,” “sharing,” or use for targeted advertising even when no money is exchanged. SMS consent information is excluded from advertising use. SJRP does not provide text-messaging opt-in data, SMS consent records, or mobile numbers collected for SJRP texting to advertising providers for their own marketing or promotional purposes.

Managing Cookies

Most browsers allow you to review, block, or delete cookies through browser settings. You may also be able to use a cookie-preference tool displayed on the Site. Blocking cookies may prevent some portions of the Site from operating correctly. Cookie preferences are generally specific to the browser and device being used, so you may need to update preferences on each browser or device. SJRP periodically reviews its cookie disclosures and available controls to keep them aligned with the technologies used on the Site.

5. Text Messaging and Mobile Information

SJRP’s Text-Messaging Program

SJRP may communicate by SMS or MMS through 833-397-3422, 904-990-1200, and other SJRP local telephone numbers that are expressly identified as text-enabled.

The SJRP Admissions and Customer Care Text Messaging Program is used for one-to-one, non-marketing communications with prospective clients and family members. Messages may include:

  • Responses to inquiries.
  • General information about services.
  • Availability.
  • Scheduling.
  • Insurance-verification coordination.
  • Requested follow-up.

This program is not used for marketing or promotional text messages.

Consent for Business-Initiated Text Messages

For text messages initiated by SJRP, consent is obtained only through an SJRP-owned webform. The consumer enters a telephone number and checks a separate, optional, unchecked SMS-consent box. The form can be submitted without checking the SMS-consent box.

Some SJRP forms require a telephone number so the Admissions team can return the inquiry by voice telephone call. Providing a required telephone number does not authorize SJRP to send SMS or MMS messages. When the SMS-consent box is not checked, SJRP may use the number for a voice callback but will not initiate a text message based on that form submission.

Merely visiting the Site, accepting this Policy, entering a telephone number, or submitting a form without checking the optional SMS-consent box does not constitute consent to receive text messages.

SJRP does not use verbal consent or another offline consent method to initiate text messages under this program.

Consent to receive text messages is not a condition of receiving treatment, purchasing services, or submitting a form.

Consumer-Initiated Text Conversations

If a consumer sends a text message directly to an SJRP number advertised as text-enabled, SJRP may reply within that specific consumer-initiated conversation. A response to an incoming text is not treated as enrollment in recurring messaging and does not authorize unrelated messages.

Information Collected Through Text Messaging

When you communicate with SJRP by SMS or MMS, SJRP and its messaging providers may collect or maintain:

  • Your mobile telephone number.
  • The SJRP number involved in the conversation.
  • Message content.
  • Attachments sent through MMS.
  • The date and time of messages.
  • Message direction and delivery status.
  • Records of your consent.
  • The source and date of an opt-in.
  • HELP requests.
  • STOP requests and other opt-out requests.
  • Records necessary to manage the conversation and comply with law or carrier requirements.

SJRP may retain text-message records as part of its business, consent, customer-care, compliance, or patient records, as applicable.

Message Frequency and Carrier Charges

Message frequency varies based on the nature and duration of your interaction with SJRP. Message and data rates may apply according to your wireless service plan. Wireless carriers are not responsible for delayed or undelivered messages.

Opting Out

You may revoke consent to receive SJRP text messages at any time. Reply STOP to the telephone number that sent the message. You may also communicate an opt-out request by:

  • Calling 904-990-1200
  • Emailing compliance@sjrp.com.
  • Telling an SJRP representative that you no longer wish to receive text messages.
  • Using another reasonable method that clearly communicates your request.

Reply HELP for assistance. SJRP will process reasonable opt-out requests and record the recipient’s preference. After an opt-out is processed, SJRP will not send additional messages covered by that opt-out, except for a permitted confirmation or communication otherwise required or permitted by law.

Direct Consent and Third-Party Leads

SJRP collects SMS consent directly from the intended message recipient. Consent provided to a lead generator, lead seller, treatment directory, marketing affiliate, referral website, outside call center, advertising service, or another third party does not, by itself, authorize SJRP to send text messages. The fact that a family member, friend, healthcare provider, or referral source gives SJRP someone’s telephone number does not establish that person’s consent to receive SJRP text messages.

Mobile Information Is Not Shared for Marketing

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes. SJRP does not sell or rent mobile telephone numbers, text-message content, text-message opt-in information, or text-message consent. All categories of information-sharing described in this Policy exclude text-messaging originator opt-in data and consent. SJRP will not share text-messaging opt-in data or consent with third parties except:

  • With telecommunications carriers, messaging providers, customer-relationship-management providers, and other service providers acting solely on SJRP’s behalf to transmit, support, secure, or maintain the requested messaging service.
  • As directed or authorized by the recipient.
  • When required or permitted by applicable law.

Service providers receiving mobile information on SJRP’s behalf are not authorized to use that information for their own marketing or promotional purposes.

Sensitive Information and Text Messaging

Ordinary SMS and MMS may not provide an appropriate level of security for sensitive information. Please do not send complete medical records, detailed treatment histories, diagnoses, Social Security numbers, payment-card information, financial account information, insurance member identification numbers, passwords, or other highly sensitive information through ordinary text messaging. SJRP may ask to move a conversation to a telephone call, secure portal, encrypted communication method, or another more appropriate channel. When text-message content constitutes protected health information or a protected substance use disorder patient record, SJRP will handle it in accordance with its Notice of Privacy Practices and applicable law.

6. How Personal Information Is Disclosed

SJRP may disclose Personal Information in the circumstances described below.

Service Providers

SJRP may disclose information to vendors and service providers that perform services on SJRP’s behalf, including:

  • Website hosting and maintenance.
  • Form processing.
  • Information technology.
  • Cybersecurity.
  • Email and communications.
  • Telecommunications and messaging.
  • Customer-relationship management.
  • Analytics.
  • Advertising.
  • Payment processing.
  • Insurance-verification support.
  • Professional consulting.
  • Legal, accounting, audit, and compliance services.
  • Records storage and management.

These providers may use Personal Information only as necessary to perform services for SJRP, subject to applicable agreements, confidentiality requirements, and law.

Healthcare, Insurance, and Treatment-Related Disclosures

SJRP may disclose information to healthcare providers, health plans, insurance companies, authorized representatives, and other organizations involved in treatment, payment, or healthcare operations when permitted by applicable law and, where required, with the appropriate authorization or consent. Information protected by HIPAA or 42 C.F.R. Part 2 is subject to additional restrictions described in SJRP’s Notice of Privacy Practices and applicable law.

Legal, Regulatory, and Safety Purposes

SJRP may disclose Personal Information when it reasonably believes disclosure is required or permitted to:

  • Comply with law, regulation, legal process, court order, subpoena, licensing requirement, or governmental request.
  • Respond to an emergency.
  • Protect someone from a serious threat to health or safety, when permitted by law.
  • Protect SJRP’s rights, property, systems, clients, patients, personnel, or others.
  • Investigate suspected fraud, abuse, unlawful activity, or security incidents.
  • Enforce applicable agreements or policies.
  • Establish, exercise, or defend legal claims.

Corporate Transactions

Information may be disclosed or transferred in connection with a proposed or completed merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar corporate transaction, subject to applicable healthcare privacy and confidentiality laws.

Affiliates

SJRP may disclose information to entities under common ownership or control for legitimate administrative, operational, treatment, payment, security, compliance, or service-related purposes. SJRP does not disclose mobile numbers, SMS opt-in data, or SMS consent to affiliates for the affiliate’s own marketing or promotional purposes.

With Your Direction or Consent

SJRP may disclose information when you direct, authorize, or consent to the disclosure.

Aggregated and De-Identified Information

SJRP may use and disclose information that has been aggregated or de-identified so that it cannot reasonably be used to identify you, subject to applicable law.

7. Sale and Sharing of Personal Information

SJRP does not sell Personal Information for monetary consideration. The Site may use analytics or advertising technologies that involve disclosures of online identifiers or website activity to service providers. Under some state privacy laws, certain advertising-related disclosures may be defined as a “sale,” “sharing,” or targeted advertising even when no money is exchanged. Where applicable law provides a right to opt out of such activity, SJRP will provide or honor the legally required opt-out method. Regardless of how state law defines advertising disclosures:

  • SJRP does not sell mobile telephone numbers.
  • SJRP does not sell or share SMS opt-in data or consent.
  • SJRP does not provide mobile information to third parties or affiliates for their own marketing or promotional purposes.
  • SJRP does not use consent obtained by a third-party lead source as authorization to send text messages.

8. Data Retention

SJRP retains Personal Information for as long as reasonably necessary for the purposes described in this Policy, including to:

  • Respond to and manage inquiries.
  • Provide services.
  • Maintain patient, business, communications, and consent records.
  • Document SMS opt-ins and opt-outs.
  • Comply with healthcare, licensing, accreditation, tax, insurance, legal, and regulatory requirements.
  • Resolve disputes.
  • Enforce agreements.
  • Protect security.
  • Establish or defend legal claims.

Retention periods may vary based on the type of information, the relationship between SJRP and the individual, applicable law, and SJRP’s record-retention requirements. When Personal Information is no longer reasonably required, SJRP may delete, destroy, de-identify, or securely archive it in accordance with applicable policies and law.

9. Information Security

SJRP uses reasonable administrative, technical, and physical safeguards designed to protect Personal Information against unauthorized access, acquisition, use, alteration, disclosure, loss, or destruction. These safeguards may include access controls, authentication measures, security monitoring, workforce training, vendor oversight, secure facilities, and other protections appropriate to the nature of the information. No website, database, email system, telephone network, SMS platform, wireless network, or method of electronic storage or transmission can be guaranteed to be completely secure. SJRP therefore cannot guarantee the absolute security of information transmitted through the Site, email, SMS, MMS, or another electronic method. Do not send highly sensitive information through ordinary email or text messaging unless SJRP has instructed you to use an approved method. 10. Your Communication Choices

Text Messages

Reply STOP to an SJRP text message or use another reasonable method described in the Text Messaging section above.

Email

You may use an unsubscribe link included in a marketing email or contact SJRP to request that marketing emails stop. An email-marketing opt-out may not prevent SJRP from sending non-promotional messages relating to an existing inquiry, requested service, treatment, legal obligation, or administrative matter.

Telephone Communications

You may ask SJRP to stop nonessential or marketing calls by communicating your request to the representative or by contacting SJRP using the information below.

Cookies

You may manage cookies using browser controls or a cookie-preference tool made available on the Site. Blocking some cookies may affect Site functionality.

11. Accessing or Correcting Information

You may contact SJRP if you believe the Personal Information SJRP maintains about you is inaccurate or incomplete. Requests involving protected health information or patient records will be handled under SJRP’s Notice of Privacy Practices and applicable healthcare privacy law. SJRP may need to verify your identity before acting on a request. SJRP may also retain information when required by law or when an applicable exception permits retention.

12. State Privacy Rights

Depending on your state of residence, applicable law, and available legal exemptions, you may have rights concerning certain Personal Information. These rights may include the right to:

  • Confirm whether SJRP processes your Personal Information.
  • Request access to Personal Information.
  • Request correction of inaccurate Personal Information.
  • Request deletion of certain Personal Information.
  • Obtain a copy of certain Personal Information.

These rights are not absolute. Certain information may be exempt from a state privacy law because it is regulated by HIPAA, 42 C.F.R. Part 2, another healthcare law, or another legal exception. Include enough information to allow SJRP to identify you and understand the request. SJRP may ask for additional information to verify your identity and protect information from unauthorized disclosure. Where applicable, an authorized agent may submit a request on your behalf. SJRP may require proof that the agent is authorized to act for you and may verify your identity directly. SJRP will not unlawfully discriminate against you for exercising an applicable privacy right.

California Residents

If applicable, California residents may request information under California’s “Shine the Light” law concerning certain disclosures of Personal Information to third parties for their direct-marketing purposes. A request should include:

  • The statement “California Shine the Light Privacy Request.”
  • Your name.
  • Your mailing address.
  • Sufficient information to identify the request.

Nevada Residents

Where applicable, Nevada residents may submit a verified request to opt out of a covered sale of certain Personal Information by contacting compliance@sjrp.com.

13. Children’s Privacy

The Site is not directed to children under 13, and SJRP does not knowingly collect Personal Information directly through the Site from children under 13 without appropriate parental or legal authorization. If SJRP learns that it collected Personal Information directly from a child under 13 in a manner not permitted by law, SJRP will take reasonable steps to delete or otherwise appropriately handle the information. A parent or legal guardian who believes a child has provided Personal Information through the Site may contact compliance@sjrp.com. This section does not limit SJRP’s ability to provide healthcare services to minors or maintain records concerning minors as permitted by applicable law.

14. Third-Party Websites and Services

The Site may contain links to websites, applications, payment platforms, insurer websites, social media services, or other online resources operated by third parties. SJRP does not control the privacy, security, content, or practices of third-party services. This Policy does not apply to information collected directly by a third party through its own website or service. Review the privacy policy and terms of a third-party service before providing information to it.

15. Social Media

If you interact with SJRP through a social media platform, the platform may collect information under its own privacy policy. Information you make public through a social media service may be visible to other users. Do not post treatment information, medical information, or other sensitive information publicly on SJRP’s social media pages.

16. Users Outside the United States

The Site is intended primarily for users in the United States. Information collected through the Site may be processed and stored in the United States. Privacy and data-protection laws in the United States may differ from those in another country. Do not submit information through the Site if transferring or processing the information in the United States is prohibited by law applicable to you.

17. Changes to This Policy

SJRP may update this Policy periodically to reflect changes in its practices, technologies, services, legal requirements, or other circumstances. When SJRP makes changes, it will update the “Last Updated” date at the top of the Policy. Material changes may also be communicated through an additional notice when appropriate or required by law. The version posted on the Site is the current version. Changes to this Policy do not create retroactive SMS consent. SJRP will obtain any consent required for its communications practices separately.
